This Privacy Policy constitutes a legally binding agreement governing the collection, processing, storage, usage, disclosure, and protection of personal data belonging to Service Seekers using WAAYZY to connect with independent Service Partners.

This Policy is framed in compliance with the Information Technology Act, 2000, Digital Personal Data Protection Act, 2023, and other applicable laws of India. By accessing or using the Platform, the Service Seeker expressly acknowledges and consents to the processing of personal data in accordance with this Privacy Policy.

NATURE OF PLATFORM AND ROLE OF WAAYZY

WAAYZY acts solely as a technology intermediary facilitating digital connections between independent users. WAAYZY does not directly provide services, supervise Service Partners, or control service execution.

All Service Partners operate independently and are solely responsible for their conduct, actions, services, pricing, and behaviour. WAAYZY shall not be liable for fraud, theft, assault, cheating, negligence, robbery, criminal misconduct, or unlawful activities committed by any user.

SCOPE AND APPLICABILITY

This Privacy Policy applies exclusively to all Service Seekers accessing or using the Platform. It governs all personal data processed through the Platform irrespective of access method or device. This Policy does not apply to third-party applications, payment systems, external links, or independent services integrated with the Platform. WAAYZY shall not be liable for third-party privacy practices or actions.

COLLECTION OF PERSONAL DATA

WAAYZY may collect personal data including name, phone number, email address, location information, booking details, communication records, payment references, device information, IP addresses, browser details, behavioural analytics, and usage logs. Location information may be collected subject to applicable permissions and user consent. WAAYZY may also receive information from third-party providers, verification systems, analytics services, and lawful authorities where permitted under law.

PURPOSE OF DATA PROCESSING

Personal data is processed for account creation, service facilitation, communication handling, security monitoring, fraud prevention, dispute management, legal compliance, customer support, analytics, operational improvement, and enforcement purposes. Aggregated and anonymized information may additionally be used for research, analytical, and service optimization purposes.

WAAYZY processes personal data based on lawful consent, contractual necessity, legal obligations, fraud prevention requirements, and legitimate operational interests. Consent is obtained through explicit acceptance of Platform policies and permissions.

DISCLOSURE AND SHARING OF DATA

WAAYZY may share Service Seeker information with Service Partners where necessary to facilitate communication, bookings, or operational functions. Data may additionally be shared with technical service providers, analytics systems, hosting providers, payment gateways, or lawful third-party vendors operating under confidentiality obligations.

WAAYZY further reserves the right to disclose user data to police departments, cyber authorities, government agencies, courts, investigating agencies, or regulatory authorities without prior notice where legally required or where necessary for investigations involving fraud, robbery, theft, cheating, assault, harassment, or criminal activity. Such disclosure shall not constitute breach of privacy obligations.

DATA SECURITY

WAAYZY implements reasonable safeguards including encryption systems, secure infrastructure, restricted access controls, and monitoring mechanisms to protect personal data. However, the Service Seeker acknowledges that no online platform can guarantee complete security. WAAYZY shall not be liable for cyber attacks, hacking incidents, unauthorized access, data breaches, malware attacks, or technical failures occurring beyond its reasonable control.

DATA RETENTION

WAAYZY retains personal data for operational, legal, compliance, evidentiary, dispute resolution, fraud prevention, and enforcement purposes. Certain data may continue to be retained after account deletion where required for investigations, legal defense, or compliance obligations.

Service Seekers may have limited rights to access, review, correct, or request deletion of personal data subject to verification, legal obligations, operational requirements, and evidentiary preservation needs.

WAAYZY reserves the right to reject requests that may interfere with legal compliance, investigations, or platform security.

USER SAFETY, RISK ASSUMPTION AND LIABILITY LIMITATION

The Service Seeker acknowledges that WAAYZY merely facilitates independent user connections and does not guarantee safety, conduct, reliability, or intentions of any Service Partner. All interactions and services are undertaken entirely at the sole risk of the Service Seeker. WAAYZY does not provide insurance, compensation, or safety guarantees. In the event of injury, theft, robbery, harassment, fraud, criminal activity, disability, or death, WAAYZY shall bear absolutely no liability whatsoever.

WAAYZY operates solely as a technology-enabled intermediary platform facilitating digital connections between independent Service Partners and Service Seekers. WAAYZY does not directly provide services, does not employ Service Partners, and does not supervise or control the execution of services.

All Service Partners operate independently at their own risk, responsibility, pricing, methods, schedules, and operational discretion. Any communication, engagement, booking, negotiation, or transaction between users is voluntary and independent. Accordingly, WAAYZY shall not be liable for any misconduct, fraud, negligence, theft, robbery, assault, cheating, criminal breach of trust, harassment, or unlawful activity committed by any user under the Indian Penal Code, 1860 or any applicable law.

Such data may include name, mobile number, email address, address, photographs, identity verification documents including Aadhaar, PAN, driving license, or other government-issued identification.

Additional data may include professional information, service history, ratings, reviews, communication records, transaction references, booking history, behavioural patterns, technical logs, IP addresses, browser details, device identifiers, and usage analytics.

Location data may also be collected subject to applicable permissions and user consent. WAAYZY may further receive information from verification agencies, analytics providers, security systems, or lawful authorities.

PURPOSE OF DATA PROCESSING

Personal data is processed for enabling account creation, facilitating connections between users, communication handling, verification processes, fraud prevention, legal compliance, platform integrity, customer support, grievance handling, dispute management, audit purposes, and operational improvements.

WAAYZY may additionally use anonymized, aggregated, or statistical data for research, analytics, security enhancement, and service optimization purposes.

WAAYZY processes personal data on the basis of lawful consent, contractual necessity, legal obligations, platform security requirements, fraud prevention measures, and legitimate operational interests. DISCLOSURE AND SHARING OF DATA

WAAYZY may share Service Partner data with Service Seekers where necessary to facilitate bookings, communication, or operational requirements. Data may also be shared with third-party vendors, hosting providers, analytics providers, payment systems, verification agencies, or technical service providers operating under confidentiality obligations.

WAAYZY further reserves the unconditional right to disclose personal data, communication history, logs, booking details, location information, transaction references, and identification records to government authorities, courts, cyber cells, police departments, investigating agencies, regulatory authorities, or lawful entities without prior notice whenever required under applicable law or for investigation purposes involving offences such as fraud, theft, robbery, cheating, assault, or any criminal activity. Such disclosure shall be lawful and shall not constitute breach of privacy or confidentiality obligations.

DATA SECURITY

WAAYZY implements commercially reasonable and industry-standard safeguards including encryption systems, access controls, logging systems, monitoring mechanisms, secure infrastructure, and restricted access protocols to protect personal data from unauthorized access, misuse, alteration, or disclosure.

However, the Service Partner acknowledges that no digital system or internet-based platform can guarantee complete or absolute security. WAAYZY shall not be liable for unauthorized access, cyber attacks, hacking incidents, malware attacks, system failures, data breaches, or losses occurring beyond its reasonable control despite implementation of reasonable security practices.

DATA RETENTION

WAAYZY retains personal data only for as long as necessary for operational, contractual, legal, security, compliance, dispute resolution, fraud prevention, evidentiary, and enforcement purposes. Certain information may continue to be retained even after account deletion or deactivation where required under applicable law or for investigation, legal defense, audit, or compliance obligations.

The Service Partner acknowledges that deletion requests may be restricted where data retention is necessary to protect the legitimate interests or legal rights of WAAYZY.

USER RIGHTS

Service Partners may have limited rights to access, review, correct, or request deletion of personal data subject to verification, legal obligations, security requirements, evidentiary preservation, and operational limitations.

WAAYZY reserves the right to reject or defer requests where compliance with such requests may interfere with investigations, legal obligations, fraud prevention mechanisms, audit requirements, or platform security.

USER SAFETY, RISK ASSUMPTION AND LIABILITY LIMITATION

The Service Partner expressly acknowledges that WAAYZY merely acts as a digital connection platform and does not guarantee safety, reliability, behaviour, background verification, conduct, intentions, or actions of any user. All interactions, meetings, communications, negotiations, and services are undertaken entirely at the sole risk of the Service Partner.

WAAYZY does not provide insurance, compensation, protection coverage, safety guarantees, or financial assistance. In case of accident, injury, permanent disability, temporary disability, illness, hospitalization, theft, robbery, assault, harassment, fraud, criminal activity, or death occurring during or after service engagements, WAAYZY shall have absolutely no liability.

WAAYZY shall further not be liable for loss, theft, damage, or destruction of tools, machinery, vehicles, hardware, equipment, instruments, or assets belonging to Service Partners.

PERSONAL SAFETY AND PRECAUTIONARY RESPONSIBILITY

WAAYZY does not provide security monitoring systems, escort services, emergency protection, or physical safety supervision. Service Partners, including female Service Partners, are strongly advised to independently take precautionary measures before accepting bookings, especially during late hours or in isolated locations.

WAAYZY shall not be liable for harassment, assault, stalking, intimidation, abuse, criminal acts, or misconduct committed by any user during or after service engagements. The Service Partner voluntarily assumes all risks associated with personal safety.

DISABILITY, INJURY AND MEDICAL LIABILITY DISCLAIMER

WAAYZY expressly disclaims all liability relating to physical injuries, mental trauma, disability, impairment, medical conditions, hospitalization, emotional distress, or health-related incidents arising from use of the Platform or services rendered through it.

WAAYZY does not provide health insurance, disability insurance, medical reimbursement, or compensation schemes. Service Partners are solely responsible for arranging their own insurance, healthcare, medical preparedness, and personal safety.

USER OBLIGATIONS AND LEGAL COMPLIANCE

The Service Partner agrees to comply with all applicable laws, regulations, taxation requirements, labour obligations, and operational standards. Any unlawful activity including fraud, theft, cheating, harassment, criminal intimidation, misrepresentation, assault, or cyber offences shall remain the sole responsibility of the concerned user.

WAAYZY reserves the right to cooperate fully with authorities and disclose user data without notice whenever legally required.

Face Data and Verification

WAAYZY may collect and process facial image or face-related data solely for identity verification, user authentication, fraud prevention, and platform security. Face data will not be used for advertising or unrelated profiling.
Face data may be retained for as long as the user maintains an account on WAAYZY and does not submit a valid account-deletion request, subject to applicable legal, regulatory, security, fraud-investigation, or evidentiary retention requirements.

WAAYZY does not sell, rent, or share face data with third parties for their independent advertising, marketing, commercial, or profiling purposes. Disclosure may occur where required by law, lawful government or law-enforcement requests, or where necessary to protect WAAYZY, its users, or legal rights.

WAAYZY will implement reasonable technical and organisational safeguards to protect personal and face data against unauthorised access, misuse, alteration, or disclosure, subject to applicable law.
