INTERMEDIARY STATUS AND STATUTORY SAFE HARBOUR

WAAYZY operates strictly as a technology intermediary platform within the meaning and scope of the Information Technology Act, 2000 and the applicable intermediary rules framed thereunder. The Platform merely provides a digital and technological interface enabling independent users to connect, communicate, negotiate, and transact with one another.

WAAYZY does not initiate, create, select, control, supervise, monitor, alter, or influence any transaction, communication, booking, negotiation, service execution, pricing arrangement, or interaction between users. The Platform functions solely as a passive facilitator and shall not be interpreted as exercising operational, contractual, supervisory, managerial, or physical control over any Service Partner or Service Seeker.

To the maximum extent permissible under Indian law, WAAYZY claims and reserves all statutory protections available to intermediary platforms and shall not be held liable for any information, communication, conduct, service, or activity generated, transmitted, performed, or facilitated by users through the Platform. Service Partners expressly acknowledge that WAAYZY’s role is limited to technological facilitation and that no agency, employment, partnership, principal-contractor, or supervisory relationship exists between WAAYZY and any user.

COMPLETE WAIVER OF LIABILITY FOR USER INTERACTIONS

By registering on or using the Platform as a Service Partner, you expressly, voluntarily, knowingly, and irrevocably agree that all communications, negotiations, meetings, bookings, service engagements, transactions, and interactions undertaken with any user are entirely independent and conducted at your sole risk and responsibility.

The Service Partner hereby fully waives, releases, discharges, and relinquishes any and all claims, causes of action, demands, complaints, damages, liabilities, proceedings, or legal rights against WAAYZY arising directly or indirectly from any user interaction or service engagement. Such waiver shall include claims arising from negligence, misrepresentation, omission, contractual disputes, service dissatisfaction, financial loss, injury, criminal activity, breach of duty, or any alleged civil or criminal liability.

The Service Partner acknowledges that WAAYZY neither guarantees user conduct nor undertakes any obligation to supervise or verify the intent, behaviour, reliability, or actions of users.

ABSOLUTE NON-LIABILITY FOR CRIMINAL ACTS

WAAYZY shall not, under any circumstances whatsoever, be liable for any criminal act, unlawful activity, or illegal conduct committed by any user of the Platform. This includes, without limitation, offences punishable under the Indian Penal Code, 1860 including theft, cheating, criminal breach of trust, robbery, extortion, assault, intimidation, harassment, cybercrime, sexual offences, trespassing, or any other criminal act.

The Service Partner expressly acknowledges that WAAYZY cannot and does not guarantee the intent, morality, background, or conduct of any user and that any unlawful activity shall remain solely attributable to the individual committing such act. WAAYZY shall not incur any vicarious, contributory, indirect, secondary, or consequential liability arising from criminal conduct of users.

EXCLUSION OF VICARIOUS AND INDIRECT LIABILITY

WAAYZY expressly disclaims all forms of vicarious liability, indirect liability, contributory liability, secondary liability, joint liability, or assumed responsibility arising from the conduct, omissions, negligence, or unlawful acts of users. Service Partners expressly agree that WAAYZY shall not be considered an employer, principal, contractor, franchise owner, supervisor, business operator, staffing company, labour provider, or controlling authority in relation to any user activity or service engagement. Any attempt to impose liability upon WAAYZY under any theory of agency, employment, partnership, supervision, joint venture, enterprise liability, or negligent facilitation shall be contractually opposed and disclaimed to the fullest extent permissible under law.

FINANCIAL, PAYMENT, LOAN AND INTEREST DISCLAIMER

WAAYZY is not a financial institution, banking entity, escrow provider, lender, debt collector, guarantor, investment advisor, payment recovery service, or financial intermediary. Any financial dealings between users, including service payments, advances, loans, interest arrangements, deferred payments, credit transactions, deposits, or recoveries, are entirely independent arrangements undertaken solely between the concerned parties.

WAAYZY shall not be liable for financial fraud, non-payment, delayed payment, recovery disputes, bounced payments, loan defaults, interest-related disputes, chargebacks, monetary losses, or financial misrepresentations. The Service Partner expressly waives all rights to claim compensation, reimbursement, or recovery from WAAYZY in relation to financial matters.

LABOUR LAW AND EMPLOYMENT SHIELD

The Service Partner expressly acknowledges that they are operating independently as a self-employed individual or contractor and not as an employee, worker, representative, payroll staff, labourer, consultant, or agent of WAAYZY.

WAAYZY shall not be responsible for wages, minimum wages, overtime, provident fund, gratuity, insurance, bonuses, employee benefits, workplace safety obligations, leave entitlements, labour welfare contributions, tax deductions, or any statutory obligations under labour laws or employment laws of India.

No employer-employee relationship shall arise or be inferred under any circumstances, and the Service Partner shall independently bear all legal, financial, operational, and statutory obligations relating to their services and activities.

ACCIDENT, INJURY, DISABILITY AND DEATH DISCLAIMER

WAAYZY expressly disclaims all liability for any accident, injury, bodily harm, permanent disability, temporary disability, medical condition, emotional distress, hospitalization, trauma, or death arising directly or indirectly from use of the Platform or services performed through it.

The Service Partner acknowledges that WAAYZY does not provide accident insurance, health insurance, disability coverage, compensation schemes, worker benefits, medical reimbursement, or emergency support of any kind. Any claim for damages, compensation, treatment expenses, disability support, or death compensation shall not lie against WAAYZY under any circumstances.

PERSONAL SAFETY AND ASSUMPTION OF RISK

The Service Partner expressly acknowledges and agrees that WAAYZY does not provide any safety assurance, police verification guarantee, physical protection, escort service, emergency monitoring, or personal security system. All interactions and service engagements are undertaken entirely at the sole and independent risk of the Service Partner.

The Service Partner voluntarily assumes all known and unknown risks relating to physical harm, harassment, abuse, intimidation, criminal activity, violence, misconduct, stalking, robbery, assault, or unlawful acts committed by users or third parties.

PROPERTY, TOOLS AND EQUIPMENT DISCLAIMER

WAAYZY shall not be liable for any theft, damage, destruction, loss, misuse, malfunction, or disappearance of tools, machinery, vehicles, equipment, hardware, instruments, materials, or assets belonging to Service Partners.

All such assets are used solely at the Service Partner’s own risk and responsibility. Any disputes regarding missing tools, damaged equipment, operational losses, or property destruction shall remain exclusively between the concerned users.

NO WARRANTY AND “AS-IS” BASIS

The Platform is provided strictly on an “as-is”, “as-available”, and “without warranties” basis. WAAYZY makes no representations or warranties, express or implied, regarding reliability, availability, suitability, uninterrupted access, service outcomes, user conduct, compatibility, or non-infringement. WAAYZY expressly disclaims all warranties including implied warranties of merchantability, fitness for a particular purpose, performance expectations, or operational continuity.

DATA DISCLOSURE AND LEGAL AUTHORITY COOPERATION

WAAYZY reserves the unconditional and absolute right to disclose Service Partner information, records, communication history, transaction logs, device information, location data, booking details, identity documents, and other information to governmental authorities, courts, cyber cells, investigating agencies, law enforcement departments, or regulatory authorities whenever required under applicable laws or for investigative purposes.

Such disclosure shall be considered lawful, authorized, and necessary and shall not constitute breach of privacy, confidentiality, or contractual obligations.
